TEXAS EXPANDS TELEMARKETING RULES TO INCLUDE TEXT MESSAGING

As of September 1, 2025, Texas has expanded its telemarketing rules to include SMS and MMS text messages.

This means that businesses sending automated calls or text messages to Texas residents may need to register with the Texas Secretary of State by filing Form 3401.

Some organizations remain exempt, including publicly traded companies, nonprofit organizations, and certain regulated entities such as banks and financial institutions.
