A Franchise Disclosure Document, or FDD, is the legal document you must give to potential franchisees before they buy a franchise. Federal law requires it, and some states require you to register it. It tells franchisees everything important about your business, history, fees, and obligations.
Most businesses can be ready to sell franchises in three to six months. Creating your FDD takes six to ten weeks. State registrations add another four to twelve weeks depending on which states you need.
Fourteen states require registration: California, Hawaii, Illinois, Indiana, Maryland, Michigan, Minnesota, New York, North Dakota, Rhode Island, South Dakota, Virginia, Washington, and Wisconsin. Missing registration can result in fines and rescission rights.
